Last week, I have send my representative friend to Main official liquidator there to find out actual situation...according to him OL office has distributed 1st notice to 70% people till now and still they are sending claim admission notices...
.This will take few months more and after that OL will prepare for sending 2nd notice for submission of original documents..which can take another year or two..And for people who are non Mumbai residents are advised to send any communication through India Post so that they can get properd acknowledgement of delivery of their documents to Mumbai OL office..
Do not use local or unworthy courier.

6. Interest at 24%p.a
on admissible amt. till date of winding up on your monthly rental.
7. Additional compensation as per M.O.U will be admissible only if it
becomes due before the date of winding up.
8. Subject to Surrender of original copies of M.O.U., Receipts,
Preference shares to this office and also subject to condonation of delay by
the Hon’ble High Court if your claim has been filed after 30th April

FIR not required in this claim process. you should have submitted your claim petition before official liquidator attached to High Court of Bombay. Official liquidator attached to High Court of Bombay was appointed by High Court of Bombay to liquidate the company , to receive the claims and dispose the claim. last date to submit claims was 30/4/2013. now what you can do go through other replies.

Myself Mubark Kazi from Mumbai, I am one of the investor in City realcom, On 20th January I received notice of Admission of Prof. I am working in gulf (muscat) unable to go personally at liquidator office hence one of my relative went there. And office bearer ask him to submit the condonation of delay as we have submitted ‘AFFIDAVIT OF PROOF OF DEBT ‘on 9th January 2014 (on notary paper issuing date stamped) with back date April 2013.
My same relative contacted few Advocate in Mumbai but they are not aware about the format. Sir, could you please help me in this case. What need to be done, do I need to submit condonation of delay? And if yes without my presence is it possible and could you please guide me about the format.

Dear Waite you are not one person affected in this there are so many. So no need to do anything at present waite let the process of surrendering of documents starts. If others comes than we can think for filing condonation of delay because for filing one file case is very costly. Just waite and and have contact, if number of people comes than we can think on this. at present no need to hurry. just waite for some time.

Dear you might have received admission notice, with calculation sheet. so your claim has been accepted and as per amount mentioned in that admission notice you will get the amount, if you have any objection than you can raise your objection with regard to calculation within 21 days. for surrendering documents another final notice will come for that wait 6 months.

Dear make your court claim petition in format of Form -66 on and attach documents xerox copy and affix required Court fees of Rs. 5/- and get it attested from Notary Public, if you will get it back dated better, otherwise at the time of claim disposal you have to produce order from High Court of Bombay for Condonying delay. ReplyDeleteI had submitted all documents (MOU, Agreement & Payment Receipts) on 26th Apr, 2011 to Additional Commissioner of Police - Mumbai and also had filled petitions for City Limouzines (India) Ltd & City Realcom.
Again submitted copies of Agreement and MOU along with all the three payment receipts on 8th June, 2012.
Further to this, I have received claim admission two notices which are showing my claim only for Rs.94,500/- and Rs.99,831/- with “No any Interest Amount”, where as I have invested total sum of Rs.2,49,831/-
Also it is not showing Rs.56,010/- invested with City Co-Op Credit Society which is also a part of City Realcom.
So after receiving 1st Admission notice, I immediately submitted my objection of “interest not included in claim and lesser amount in notice” on 16th March, 2016, and I received second admission Notice in which also there is “No any Interest Amount” given stating that No MOU/Agreement attached whereas, I had submitted all MOU and Agreement with Receipts twice.
Kindly advice that what shall be done in this case.

ReplyDeleteI am from Mumbai. I visited official liquidator office today 15/02/2017 for inquiry about my claim letter.
They told me that official liquidator has already filed a complaint dated 28/09/2016 which were found for irregularities in the process of adjudication of claims and also the same is pending for the investigation by the concerned department. In the present scenario the court is addressing that the adjudication claims is presently under way and being conducting by Chartered Accountants in the matter shall not proceed. The official liquidator shall file a progress report before 25/10/2016 and it is stand over to 27/10/2016.
Dear I know full story, what has happened, there is corruption charges on Two Chartered accountant and one Deputy Official liquidator, issuing admission letters to 36 Investors by taking money. Investigation completed and report shortly will be submitted in High Court and process will start soon, Need not to worry.

Dear Investors High Court of Bombay has passed a very detail order on 9th June 2017, with regard claims and company properties. All company properties and its Managing director Mr. Masood all properties has to be auctioned within period of 6 months time frame from 9th June 2017 than claims will be disposed.
