LAST DATE FOR SUBMITTING CLAIMS 30/04/2013 in City Limouzines and City Realcom Matters

As you all are well aware that all the FIR's and complaints given to different EOW or police stations and U/s 138 N I Act cases, from all over India ,all  have been transferred by Honorable Supreme Court by its order dated 11/5/2015 to Addl Sessions Court, PMLA court Greater Mumbai for trial. so if any body, who has not filed any claim before official liquidator High Court of Bombay, file it. EOW's has no role in this liquidation matter now. Rest your money and your choice. 

CLAIMS ADJUDICATION STARTED AND ADMISSION NOTICES FOR DEBT FROM OFFICIAL LIQUIDATOR IS STARTED COMING TO INVESTORS, AFTER THIS PROCESS-  ORIGINAL DOCUMENTS VERIFICATION WILL START.

 INVESTORS RECEIVED ADMISSION NOTICES FOR THEIR CLAIMS

MAIN POINTS
1.     After receiving Admission Notice, you  have to raise your objection with regard to their calculation of amount if any within 21 days from receipts of the notice to official liquidator.

2.      Basis of claims is receipts and M.O.U., as per their notice as per there time limit is  with in 21 days, amounts admitted as per receipts.

3.    Compensation for balance number of months, commencing August 2009

4.      All applicable rate/s. Mid year rate in case of annually varying rates

5.      No Compensation beyond the months immediately preceding the date of winding up.

CITY REALCOM LTD
Example :        As liquidation order for City Realcom Ltd 09 March 2012 so compensation up to 28/2/2012 only means 31 months.
  
 CITY LIMOUZINES(I) LTD
    Example:       As liquidation order for City Limouzines (India) Ltd 09 Dec 2010 so up to 30/ 11/2010 so compensation will be  only for means 16 months only, plus your preference shares value if any.

6.     Interest at 24%p.a on admissible amt. till date of winding up on your monthly rental.

7.     Additional compensation as per M.O.U will be admissible only if it becomes due before the date of winding up.

8.   Subject to Surrender of original copies of M.O.U., Receipts, Preference shares to this office and also subject to condonation of delay by the Hon’ble High Court if your claim has been filed after 30th April 2013.

9.    And take further notice that subject to the power of court to extend the time, no application to reverse or vary my decision in rejecting either in full or in any part, any of your claim as aforesaid will be entertained after the expiry of 21 days from the date of service of this notice.

These Admission of claims is according to your claims and receipts and MOU/ Agreement provided by you, with your claim petition.

Everybody (All India Investors) have to submit his/her claim petition to official liquidator attached to High Court of Bombay Only.

The petition is to be drafted in the form of Court petition. On each claim petition you have to put required Court fee as specified by official liquidator and it is to be drafted on Green legal paper and to be duly attested by Notary Public of Government of India below before Me on main claim petition  After due date to accept the claim or not, it is the discretion of official liquidator or you have to file a petition to high Court of Bombay for permission/ or to issue Direction to submit claim after due date.

It is individual investor money, if you will claim, you will get something whatever amounts it may be. when you will get that you can lision with official liquidator attached to High Court of Bombay, above given address, If you do not put claim you will not get anything. Your money, your choice.

  6. Dear Investor High Court has orderde these companies for liquidation means selling their properties and releasing their money to official liquidator. Official liquidator is authorized to liquidate all the property of these two companies and dispose the claims of investors who have filed claims before him. you should have submitted xerocx copy of papers duly notarized with claim petition or Form-66, by registered post or speed post to official liquidator attached to High Court of Bombay. Go through the procedure written on this blog by me.

  8. Dear Investor, if you would have gone through questions and reply on this subject. you should have got your answer.
    Both the Companies has been ordered for Liquidation and if you want to claim your investment money , you should have submitted you claim to official liquidator attached to High Court of Bombay. Last date for submission claims was 30/4/2013. But still you submit your claim petition to official liquidator as early as possible. Already Rs. 180 Crores has been released to official Liquidator by order of High Court of Bombay.

As salamualiakum bhai, Am Fiyaz (Chennai), we submitted some document at the time of fraud declared but not sure how effecttive the document or file registered and therefor we haven't receive any communication and we are constantly on track with the affected people. I just gone through the message mentioned above so can you get us the latest update on it & let us know if any formalities or still to be given on.

    The money is very essential for us so please help, Inshallah allah may reward you in Akhirah for any kind of favor you did for us in this regards.

  14. walekum salam There is liquidation order from High Court of Bombay for Both companies City Limouzines and city Realcom ltd, If you want to claim your investment money, you have to submit claim petition with Xerocx copy of documents duly attested by Notary Public including claim petition. Though last date for submitting claims was 30/4/2013 as per paper publication notifications.

    First Submit your claim petition to official liquidator attached to High Court of Bombay by making in back date. means before 30 Apr 2013 date only, as early as possible, if you want to claim your money. for making claims take the help of Local Advocate.

    if you can not do than second option to you, take direction from high Court of Bombay to submit your claims. whichever is easy for you , do it accordingly.
    Already Rs. 180 Crores released to official liquidator, First submit your claims
    where you have submitted your documents, you can ask them what is to be done. I have clearly written in this topic. without putting claim petition , you will not get any penny because distribution and disposal of claims is under single window system to all India Investors that is official liquidator.

  16. Dear Sir, Needed some clarification. The original documents which we received from City realcom (in chennai) have been misplaced in transit when shifting to a different city. We however have the bank statement confirming the original amt paid to City Realcom Ltd by cheque. Pls let us know if there is any way to retrieve the original documents. Regards

  17. First you put your claims than search your documents it is misplaced only as per your statement. At the time of disposal of claims you have to take originals to Official liquidator office.

  18. Sir, 1st of all I heartly appreciate ur great efforts towars this issues. I am from mumbai and having two file in City group and made all formalities of claim for outstanding dues. Sir message had come that some of Rs. 180 crores released to official liquidator of mumbai and other property and money will also be released soon in respect of disposing of claim. Dear Order Copy on this blog is available. another movement they will start disposing claims they will give notice to you as per your claim address and for 6 months no distribution of money is going to take place. It is High Court of Bombay order. to start other formalty High Court has passed an order to Official liquidator in this matter. go through Order copy or personally go and visit official liquidator office at Mumbai.

      Long back both the Companies has been ordered for Liquidation and it was published in different language news papers for depositing claims on 29 March 2013 even on T.V also it came and if you want to claim your investment money , you should have submitted you claim to official liquidator attached to High Court of Bombay. Last date for submission claims was 30/4/2013. But still you submit your claim petition to official liquidator as early as possible. Already Rs. 180 Crores has been released to official Liquidator by order of High Court of Bombay.

    There is one Form-66, template you will get on Ministry of Corporate Affairs website , that is to be drafted in the form of court petition, with this you have to attach your documents xerocx copy duly attested by Notary Public. Last date is already over so make the documents in back date and send it to Official liquidator attached to High Court of Bombay by post. Go through the procedure written on this blog by me and make your documents and send as early as possible.

I have nothing to do with your investment. you contacted me for claims. some Rs. 200/- crores already has been released to official liquidator, you can contact official liquidator at above given numbers.     I've had submitted my claim in June'2013 ( not back dated) even though when the last date for the submission for the claims was 30th April'2013. My claim form was delivered to the official Liquidator on 10th June'2013 according to Bluedart courier but I haven't received any official receiving confirmation from the liquidator yet. Is there any hope in my case of getting the claim when I've submitted the claim form late.

    I also invested in City Realcom & City Co-opeartive Credit Society and submitted all the document notorized as well with the application ( this application is already sent to EOW in 09 ) stating claim amount, but not used form 66. Am i eligible for the claim ?

    1. EOW has no role in this liqudation order passed by High Court of Bombay and official liquidator is appointed by High Court of Bombay.so you should have submitted your claim to official liquidator if you want to claim your money. still submit your claim to official liquidator

Dear in June 2010, there was no order from Court first order came in Dec 2010 for city limouzines and another order of liquidation came on City Realcom ltd came on 9th March 2012. how you deposited your claims and where you deposited claims before official liquidator attached to High Court of Bombay. where and when you submitted your claims ???

  41. I have given you answer clearly to your question. your complaints in the City Commissioner Office & Economical Crime Branch in Chennai in 2009 has nothing to do with your claims. Liquidation has been ordered by High Court of Bombay. if you want to claim your money submit the claim to Official liquidator attached to High Court of Bombay. rest it is your money, your choice, I have replied your question clearly first time itself.

My case as I invested RS 1,29,010.00 dated 03-02-2008 and get return back monthly @ Rs 7775.00 for 15months to Rs1,16,625.00. So, May i approch you for get refund for balance principle.

    1. If you send your documents by way of speed post, registered post and through Courier, you can check for its delivery. If you want to check your name than go to official liquidator there is one register from which they gives inward number you can check in that register, no such list on internet.

    we have to fill form 66 for all 3 companies i.e. city limouzines , city realcom & City co-operative credit society in one form or all 3 forms separately ? Moreover I just want to confirm do we need to mention all share certificate numbers. folio number , and issue date and due date etc on form 66 or we just need Xerox copy of those papers duly certified by notary will suffice ? there is no wind up petition against co-operative society so in which case number we have to claim that money ?? Moreover as mentioned on form 66 that it has to be filled by advocate or authorised person on investor behalf not by investor himself. Please clarify. Also can u post one sample duly filled form 66 for guidance ?

Investor has to file his claim, Advocate or authorised person not required in this matter. you have to submit claim for city limouzines and city realcom ltd, rest meet any local Advocate he will draft petition as per your documents. details are given here above with regard to Company petition number and order date. I do not provide any drafted petition.

    1. Dear Investor I have not mentioned any where Stamp Paper. Stamp paper is not required at all in this. One Petition is to be drafted in the Court Affidavit Format or in the Form of Form-66 of Company Liquidation claims. It is to be Made on Simple Green Legal Paper. Submit claims, If wants to Put Claim.

    2. sir i went to the official Liquidator office,took the form from there and asked them the format to fill it. now my question for you is that, i have invested in 4 realcom and 2 city limouzine scheme.so shall i file the petition differently as in fill 6 forms n do notary differntly or just fill two forms, one for the 4 realcom and one for the two city limouzine .. i asked this to the person over there also, and and they said i can file all the ralcom in 1 form but other one said file it differently... and one person said that, if i file the petition now toh i will have to hire an advocate, and will have to pay the late submission fee whatever that the court orders for as claim submission last date was 30/4/2013.... and if i don't want to go through this then get an old dated notary done which should be befor the last date of submission and for this he said he will charge rs1500 per file......... please help with your advise what should i do

I am one of those who lost hard earned money in City Limouzines India Ltd. by way of debentures.When the company failed to pay their investors, The Economics Offence Wing of the Police dept,Govt Of Tamil Nadu started action; and I submitted my claim to the EOW . Shoukld I again submit cliam toi the OL at MKubbai now.

    1. here is liquidation order from High Court of Bombay for Both companies City Limouzines and city Realcom ltd, If you want to claim your investment money, you have to submit claim petition with Xerocx copy of documents duly attested by Notary Public including claim petition. Though last date for submitting claims was 30/4/2013 as per paper publication notifications.

      First Submit your claim petition to official liquidator attached to High Court of Bombay by making in back date. means before 30 Apr 2013 date only, as early as possible.
      EOW Chennai or any EOW has no role in liquidation and disposing of claims.

It is your money if you want to claim, Still you can submit by making claim petition in back date means before 30/4/2013 date. This Form template is available on Ministry of Corporate affairs website, get it drafted in the form of court petition format. I do not send any draft petition to any investor.

    Dear Sir, i have come to know about this just now only. i had invested for three accounts in city limouziness, and regarding claim procedure i was not aware and didn't got any information how to do the claim, please sir can you help me out in this matter, as your blog showing last date of file petition is already over, After the scam found, i have inquired to city's office but didn't got any response and after that office also closed ( grant road office ) please suggest me what to do in this should i contact to above mentioned Official Liquidator, or Should i have to give any petition to mumbai high court? Today only i saw this blog and saw the option of giving petition to high court. Please guide me what steps i will have to now to get the money. or may i contact you on your mail. please do the needful.

      Dear I think you are from Mumbai, You can visit official liquidator office at MG ROAD, My opinion there are two ways Either you take permission for condoning delay in filing claims from High Court of Bombay or make your Claim petitions in back date and get notarized all documents and Claim petitions from Notary Public of Govt of India before 30/4/2013 date and send it by Speed post / Registered post to official liquidator attached to High Court of Bombay. Whatever feasible to you , you can proceed.

    1. You go and ask to official liquidator, he can tell you estimated time, but in my opinion it should take 8 to 12 months maximum. Rest official liquidator only can tell.

    I too had invested 3 Lakhs in City Realcom, and had lost the hope whether i got the money back and only today i got to know from souces that there are still some hopes where will get our money back.

  70. One more question. I had visited the office of the liquidator during 2011 and when the official liquidation for city realcom was not effected. I had collected a green form from them., but there is no mention of the form no. on the same. Do I use the same one. The form 66 you mention says Highcourt Chennai whereas the one I have refers to high court Mumbai. I am confused which form I should use. Kindly advise

Dear Investor, High Court of Bombay passed an order of liquidation and appointed official liquidator attached to High Court of Bombay and released cash and other property and another cash of approximately 350 crores is pending due to Bombay High Court not having jurisdiction that also I hope it will be released to official liquidator after that those who have submitted claims that will be disbursed as per High Court of Bombay order.

    I am Shoaib Mohammed from Hyderabad, I have invested my money in 5 scheme in city limouzine among 3 persons in the same family. I had invested from the year 2007-2009, from 2009 my cheques have been bounced. I also have the documents and share certificates issued by them.
    I want to ask you that how to claim for the one, should I file a single claim for all the five investment or partially and should send one form 66 or multiple.
    Is there any fees to be send by the courier along with the form 66 or not, if it is then how much?
    I have downloaded the form from the below given link please check it,

    1. Dear this is not form-66 it is for company returns, it has to be drafted in the format of court petition . Last DATE was 30/4/2013 so if you want to submit your claim you have to make your claim petition before 30/4/2013 date and all the supporting documents has to be attested by Notary public before 30/4/2013 date including your claim petitions. seprate claim petition has to be made for each file , with covering letter you can send all files together. court fees rs. 5/ to be affixed on petition and rs. 10/- notary stamp on each petition. rest any doubt send mail to my id zulfiqar1971@gmail.com

  81. he south Mumbai district consumer forum in its recent orders directed the directors of two finance companies -- City Realcom Ltd and City Limouzines Ltd, to pay back the invested amount to 10 investors, after the complainants had approached the consumer forum. The forum has ordered the two finance companies to pay approximately Rs4.5 lakh along with the compensation cost of Rs8,000 toward the delay and litigation cost of Rs2,000 to the investors.

    The two finance companies were in news from 2009, when the firms had allegedly duped investors by floating Ponzi schemes. The Economic Offence Wing (EOW) arrested the two directors, Gita Rajaki and Masud Khan, in 2012 and both are behind bars.

    In 2011, 10 investors from Mumbai and Nasik, had approached the consumer forum pleading them to direct the firms to pay back the promised amounts along with the compensation for the lapse. According to the complainants copy, the firms had promised the investors to pay huge amount of returns if the investors engage their money with the firm.

    The consumer forum in its orders maintained, "According to the complainants, they had engaged their hard earned money and accordingly, had invested in the schemes, however, the company duped their money."

    The forum after going through the complaint has issued a notice to the two directors and had asked them to file their replies, however, none of them responded to the notice. Hence, as the complaints were unchallenged, thus the forum ordered the two firms and their directors to pay an approximate amount of around Rs4.5 lakh to the complainants along with compensation of Rs8,000 towards the delay. The forum also directed the firms to pay an additional amount of Rs2,000 towards the complainant's litigation costs.

      Consumer Forum orders directed the directors of two finance companies -- City Realcom Ltd and City Limouzines Ltd, to pay back the invested amount to 10 investors, after the complainants had approached the consumer forum.       Whether any director have the capacity to pay the money. Money is under the custody of court.

      Whether Consumer Forum can force its order against closed company. Consumer form is not a Court. Once Liquidation order passed by High Court of Bombay against these Companies and these Companies are under liquidation, Only Official liquidator is authorized by High Court of Bombay to disposed the claims. As order passed by High Court of Bombay to handover the money which is with EOW Bombay approximate Rs. 180 crores to official liquidator.

      What you want to do next filing complaint before Consumer forum or not and other places, It is your matter, take advise from your Advocates that will be better. I give advise on those matter where I have contested the matter or dealing with matter.

    1. Have you submitted your claim before order or after order. If before order than it is not valid , if after liquidation order you have submitted than it is valid, need not to do anything just waite some more time. Hope claims will be disposed early.

Dear Adjudication Started to claimant investors, and what you said that forms are accepted, they have not stopped receiving claims , but you have to get your delay condoned from High Court of Bombay, so better make your claims in back date before 30/4/2013 date and after Notary Public signature you send by speed post. As per Adjudication Notice, I have copy of Adjudication Notice, official liquidator clearly states that subject to condonation of delay by High Court if your claim has been filed after 30/4/2013.
      So I suggest make claims in back date get attested from Notary public, Put Rs. 5/- court fees on that and send by speed post with A/D card and one post of self address inside cover by pasting Rs. 5/- postal stamp.

    My query is I am holding two investment form of City Realcom @ Rs.139010 and enchased only two cheques each. So need to know from you that what claim amount should I mention in the affidavit.

    1. Dear It is not all investors, Those who have submitted their claims to official liquidator office, high Court of Bombay , only will get there claims disposed by official liquidator High Court of Bombay.
      Those not submitted their claims, official liquidator has nothing to do with those investors.

  103. Sir I and my relatives have invested in city limousine and realcom in different schemes in the mid of 2007 and in the year 2009
    and because of the closure in 2009 we have suffered badly. We recently came to know through your blog that we can still submit the claim form to the lquidator office and subsequently obtain condonation of late submission from the homourable High court. We have approached a local high court advocate, he is asking for Rs 5000 per application to get condonation of late submission from high court and he expects to get the condonation within 4-5 months. Kindly advice is the cost per file and time frame genuine?

Hello I wrote two options one to make documents in back date that option you should have tried.In a family if three four members are investors than minimum 20000 gone. if both the companies you invested than two petition has to be filed for each investors one city limouzines and one for city realcom ltd. you ask the Advocate whether he can file petition for an association in same amount. I have registered association. Time it will take minimum 4 to 6 months but no surety. Per file it is very costly as per me if you have 10 files than 50000 is gone. Better make the documents in back date and submit by speed post, if any problem in making documents in back date contact me, I can arrange from here Chennai. Rest your money and your choice. Now Adjudication of claims is in last phase.

    1. Dear Adv Atul Pandey, when you send your claim petition duly notarised to official liquidator and it came returned after one month time. It can not be because it is government department as you also know. No problem again you send claim petition to official liquidator (ATTACH to High Court of Bombay) , 5th Floor, Bank of India Building, Mahatma Gandhi Road, Fort, Mumbai- 400 023. If you submit your claim , sooner or later you will get money back.
